More former players sue NHL regarding concussions


MINNEAPOLIS — Another group of former NHL players has joined the fight for compensation for head injuries they say they incurred while playing, while at the same time targeting the violence of the game that they believe brought about those injuries.

Retired players Dave Christian, Reed Larson and William Bennett filed a class action lawsuit in federal court on Tuesday alleging that the league has promoted fighting and downplayed the risk of head injuries that come from it.

"I think the glorified violence is really the Achilles heel for the NHL," said Charles "Bucky" Zimmerman, an attorney at Zimmerman Reed that filed the lawsuit on behalf of the players. "If anything comes of this, the focus on the glorified violence and perhaps the change to that will be a good thing."

The lawsuit, which is similar to one brought by former football players against the NFL, joins others filed by hockey players in Washington and New York and seeks monetary damages and increased medical monitoring.

"As we have indicated earlier, another lawsuit of this type is not unexpected," NHL Deputy Commissioner Bill Daly said in an email to The Associated Press. "It's the nature of these types of cases that once one is filed, a number of similarly styled cases follow. Nothing changes our belief that all of these cases are without merit and they will be defended accordingly."

The NHLPA declined to comment.

Zimmerman also worked on the football litigation, which resulted in the NFL agreeing to pay a $765 million settlement to thousands of former players. That settlement is still awaiting a judge's approval, but the headlines it generated have been partially responsible for hockey players mounting their own case against the NHL.

"We've seen it in football. It's now here in hockey. It's of the same genesis," Zimmerman said. "There's knowledge, we believe, that these type of concussive injuries were known and protections were not put in place appropriately enough and fast enough and rules changes were not implemented even today in fighting.

"Players continue to be at risk and suffer as a result of those risks that they take on behalf of the sport. We think those are unreasonable and they should be changed and the players should be compensated."

The lawsuit alleges "the NHL hid or minimized concussion risks from its players, thereby putting them at a substantially higher risk for developing memory loss, depression, cognitive difficulties, and even brain related diseases such as dementia, Alzheimer's disease, and Parkinson's disease."

One argument that tries to separate the NFL litigation from the NHL case is that by engaging in fighting, players willfully take on the health risks that could come from that.

"You could make that argument only to a point," Zimmerman said. "And the point is that the fighting arena would not exist and would be outlawed as it is in every other level of the game had the NHL not condoned it and sold tickets based upon it and promoted the sport in that way. It's not the players that promote the sport in that way because the players don't implement the rules. It's the league that implements the rules. If they would outlaw fighting, there wouldn't be people who would fight."

Zimmerman said he thinks more players will join the litigation much in the same way the group of plaintiffs in the NFL case exponentially grew as it progressed.

"The light went on for them as the football players' story was becoming more told," Zimmerman said. "I think the hockey players started to see that their story was going to be heard and told. It's not that we haven't known about football players or hockey players getting hurt. It's now become more important that we talk about it and do something about it rather than just benignly let it continue into the future."

Horry County

Shading devices, other than circular umbrellas with a circular shade no greater than 7 feet, 6 inches in diameter, shall not be allowed on the beach. This includes, but is not limited to, tents, tarps, cabanas, pavilions, sports-brellas, or similar devices, or any material mounted on supports. An umbrella is defined as a collapsible circular shade consisting of a natural or synthetic fabric shade stretched over hinged ribs radiating from a central pole without grounding lines or ropes. All shading devices are prohibited from being tied, bound, joined, or connected in any manner, but otherwise shall be secured in such fashion to restrict uncontrolled movement of the device.

Myrtle Beach

Shading devices, other than circular umbrellas with a diameter of 7 feet, 6 inches or less, shall not be allowed on the beach between Memorial Day through Labor Day.

Violation: Verbal warning; According to Mark Kruea, spokesman for Myrtle Beach, the court has set $262 as the standard bond amount, or fine, for a tent violation, which includes court costs.

North Myrtle Beach

Only umbrellas with a center pole no more than 7 feet six inches in height, and with a circular canopy no more than 9 feet in diameter are allowed on the beach May 15-Sept. 15.

Violation: Verbal warning; if necessary, a misdemeanor charge, which is up to a $500 fine and/or up to 30 days in jail.

Idea of New Attention Disorder Spurs Research, and Debate


With more than six million American children having received a diagnosis of attention deficit hyperactivity disorder, concern has been rising that the condition is being significantly misdiagnosed and over treated with prescription medications.


Yet now some powerful figures in mental health are claiming to have identified a new disorder that could vastly expand the ranks of young people treated for attention problems. Called sluggish cognitive tempo, the condition is said to be characterized by lethargy, daydreaming and slow mental processing. By some researchers’ estimates, it is present in perhaps two million children.

Experts pushing for more research into sluggish cognitive tempo say it is gaining momentum toward recognition as a legitimate disorder — and, as such, a candidate for pharmacological treatment. Some of the condition’s researchers have helped Eli Lilly investigate how its flagship A.D.H.D. drug might treat it.

The Journal of Abnormal Child Psychology devoted 136 pages of its January issue to papers describing the illness, with the lead paper claiming that the question of its existence “seems to be laid to rest as of this issue.” The psychologist Russell Barkley of the Medical University of South Carolina, for 30 years one of A.D.H.D.’s most influential and visible proponents, has claimed in research papers and lectures that sluggish cognitive tempo “has become the new attention disorder.”

In an interview, Keith McBurnett, a professor of psychiatry at the University of California, San Francisco, and co-author of several papers on sluggish cognitive tempo, said: “When you start talking about things like daydreaming, mind-wandering, those types of behaviors, someone who has a son or daughter who does this excessively says, ‘I know about this from my own experience.’ They know what you’re talking about.”

Yet some experts, including Dr. McBurnett and some members of the journal’s editorial board, say that there is no consensus on the new disorder’s specific symptoms, let alone scientific validity. They warn that the concept’s promotion without vastly more scientific rigor could expose children to unwarranted diagnoses and prescription medications — problems that A.D.H.D. already faces.

“We’re seeing a fad in evolution: Just as A.D.H.D. has been the diagnosis du jour for 15 years or so, this is the beginning of another,” said Dr. Allen Frances, an emeritus professor of psychiatry at Duke University. “This is a public health experiment on millions of kids.”

Though the concept of sluggish cognitive tempo, or S.C.T., has been researched sporadically since the 1980s, it has never been recognized in the Diagnostic and Statistical Manual of Mental Disorders, which codifies conditions recognized by the American Psychiatric Association. The editor in chief of The Journal of Abnormal Child Psychology, Charlotte Johnston, said in an email that recent renewed interest in the condition is what led the journal to devote most of one issue to “highlight areas in which further study is needed.”

Dr. Barkley declined repeated requests for interviews about his work and statements regarding sluggish cognitive tempo. Several of the field’s other key researchers, Stephen P. Becker of Cincinnati Children’s Hospital Medical Center, Benjamin B. Lahey of the University of Chicago and Stephen A. Marshall of Ohio University, also declined to comment on their work.

Papers have proposed that a recognition of sluggish cognitive tempo could help resolve some longstanding confusion about A.D.H.D., which despite having hyperactivity in its name includes about two million children who are not hyperactive, merely inattentive. Some researchers propose that about half of those children would be better classified as having sluggish cognitive tempo, with perhaps one million additional children, who do not meet A.D.H.D.’s criteria now, having the new disorder, too.

“These children are not the ones giving adults much trouble, so they’re easy to miss,” Dr. McBurnett said. “They’re the daydreamy ones, the ones with work that’s not turned in, leaving names off of papers or skipping questions, things like that, that impinge on grades or performance. So anything we can do to understand what’s going on with these kids is a good thing.”

But Dr. McBurnett added that sluggish cognitive tempo remained many years from any scientific consensus: “We haven’t even agreed on the symptom list — that’s how early on we are in the process.”

Steve S. Lee, an associate professor of psychology at the University of California, Los Angeles, who serves on the editorial board of The Journal of Abnormal Child Psychology, said in an interview that he was conflicted over the journal’s emphasis on sluggish cognitive tempo. He expressed concern that A.D.H.D. had already grown to encompass too many children with common youthful behavior, or whose problems are derived not from a neurological disorder but from inadequate sleep, a different learning disability or other sources.

About two-thirds of children with an A.D.H.D. diagnosis take daily medication such as Adderall or Concerta, which often quells severe impulsiveness and inattention but also carries risks for insomnia, appetite suppression and, among teenagers and adults, abuse or addiction.

Dr. McBurnett recently conducted a clinical trial funded and overseen by Eli Lilly that investigated whether proposed symptoms of sluggish cognitive tempo could be treated with Strattera, the company’s primary A.D.H.D. drug. (One of Strattera’s selling points is that it is not a stimulant like Adderall and Concerta, medications more susceptible to abuse.) His study, published in The Journal of Child and Adolescent Psychopharmacology, concluded, “This is the first study to report significant effects of any medication on S.C.T.”

An Eli Lilly spokeswoman said in an email, “Sluggish cognitive tempo is one of many conditions that Lilly scientists continue to study to help satisfy unmet medical needs around the world.”

Representatives of the drug companies that make the best-selling medications for A.D.H.D. — Shire (extended-release Adderall and Vyvanse), Novartis (Focalin) and Janssen (Concerta) — said they are not currently conducting research into sluggish cognitive tempo. However, because the new condition shares so many symptoms with A.D.H.D., these products might easily be repositioned to serve the new market.

Dr. Barkley, who has said that “S.C.T. is a newly recognized disorder,” also has financial ties to Eli Lilly; he received $118,000 from 2009 to 2012 for consulting and speaking engagements, according to propublica.org. While detailing sluggish cognitive tempo in The Journal of Psychiatric Practice, Dr. Barkley stated that Strattera’s performance on sluggish cognitive tempo symptoms was “an exciting finding.” Dr. Barkley has also published a symptom checklist for mental health professionals to identify adults with the condition; the forms are available for $131.75 apiece from Guilford Press, which funds some of his research.

Dr. Barkley, who edits sluggish cognitive tempo’s Wikipedia page, declined a request to discuss his financial interests in the condition’s acceptance.

“I have no doubt there are kids who meet the criteria for this thing, but nothing is more irrelevant,” Dr. Frances said. “The enthusiasts here are thinking of missed patients. What about the mislabeled kids who are called patients when there’s nothing wrong with them? They are not considering what is happening in the real world.”

Tourism 2014 starts off wobbly



The start of the spring tourist season has been bumpy for many Grand Strand hotels and attractions – victims of ice storms and cold rain.

But representatives of tourist properties said that when March weather was good, so was attendance.

“We’ve had a couple of Saturdays that were as good as summer,” said Chris Walker, president of the Oceanfront Merchants Association.

With Spring Break and Easter weekend just a couple of weeks away, owners and managers are anticipating an uptick in business that will increase more and hold steady through the summer.

At least some hotels are looking at increased revenue this year, but not necessarily because of more overnight guests.

Donald Hovis, marketing manager at Springmaid Resort, said Springmaid likely will increase its rates for the summer, and he expects many other Strand hotels to do the same.

He said Springmaid’s March occupancy rate was 60 percent thanks in large part to a plethora of religious group bus tours from the Carolinas and Georgia.

“We prepared for March to be a lot less than last year,” Hovis said, “and April to be a lot more this year.”

Jim Eggan, corporate general manager for Myrtle Beach Seaside Resorts, said overall, the company’s nine properties averaged 50 percent occupancy in March, and said the rest of the spring season is looking very good. He said that the company’s hotels and condominium developments had good traffic even during the rainy spells.

People who chose to come despite the weather, he surmised, were escaping even worse weather in the Northeast and Midwest.

“We have the lure,” he said. “This is Myrtle Beach.”

Unlike Springmaid, Eggan said his properties are reluctant to raise average daily rates. Customers notice when they do, and Eggan said increased rates has them looking elsewhere.

“People expect discounts,” he said.

He expects to see occupancy increase through the rest of the spring season, which he defines as now til June, because of the advance bookings the properties already have.

Hovis said he counts Easter, whenever it falls, as the official kickoff to the tourist season and noted that Springmaid is fully-booked for the holiday.

Hovis said it’s difficult to reach 100 percent occupancy because there are always new properties being added to the Grand Strand mix. But he’s anticipating average daily rates and other revenue to make it a “bang-up” year for the resort.

Along the Grand Strand, said Stephen Greene, president and CEO of the Myrtle Beach Area Hospitality Association, his members are reporting positive signs despite an up and down March. He said that the timing of make-up days from weather-related school closing in the Northeast could lead to a slow early June.

Eggan said he’s expecting the make-up days to be during spring break days, which could suppress April bookings and not affect the start of the summer season.

Recent springs were warmer than this has been so far, and Greene said the area tourist market was boosted then by people who would drive from out-of-market areas for a weekend at the coast.

“We haven’t seen that this year,” he said.

Jessica Mula, marketing director for Ripley’s Aquarium, said that Ripley’s three attractions have seen the same kind of March as everyone else is reporting, up and down. Rain would hold down attendance at the Believe It or Not! Odditorium and Haunted Adventure on Ocean Boulevard, but would boost attendance at the Aquarium.

She said the Aquarium will debut a new Swarm attraction for the summer that should boost attendance. The exhibit shows how many animals, including humans, group in swarms to increase their chances to thrive and survive.

“It’s been very sporadic,” Buzz Plyler, owner of Gay Dolphin Gift Cover on Ocean Boulevard said of March business, “up and down, depending on the weather.”

Business for the year is behind last year, he said, but he’s expecting a very good April based on what customers are spending now at the Grand Strand icon.

While business is down so far, he said he can’t tally the spring season a success or not until after the Easter holiday.

One Myrtle Beach area offering is trying a new marketing strategy



Coldwell Banker Commercial Chicora Realty is taking an unusual marketing strategy for the 529.87 acres between S.C. 9 and U.S. 17 it has listed for sale.

No price is being advertised.

The property includes the former Bay Tree Golf Resort, and is being called Rivergrand in the sale.

It is a bank-owned multi-use development with in-place entitlements for 1,775 residential units and 600,000 square feet of commercial and office space. The residential units include 900 single-family homes, 600 multi-family and 275 units in a retirement community.

A new owner should be able to adapt the plan to their own preferences, according to Coldwell Banker Chicora.

Don Smith, president of Coldwell Banker Chicora, could not be reached for comment Friday.

But Laura Crowther, CEO of the Coastal Carolinas Association of Realtors, said Wells Fargo Bank has used the same strategy on properties it has sold in North Carolina.

The idea is to let the market determine the price, she said.

“It’s a different approach,” she said. “Not to say that it’s a bad one.”

NORTH MYRTLE BEACH — Work is winding down in the horseshoe at Main Street in North Myrtle Beach, with construction expected to be complete on the Ocean Boulevard side by April 25, a date many business owners said can’t come soon enough.

Crews have been working to install an 84-inch pipe in North Myrtle Beach that will connect to an ocean outfall structure being constructed underground within the horseshoe and travel about 1,200 feet offshore where stormwater collected from the stormwater basin will be released, a $9.5 million project.

The intersection of Main Street and Ocean Boulevard closed for construction in early February and nearby business owners said it’s had an impact on their offseason business. City officials expected the intersection only would be closed throughout February.

“It’s been slower than normal, but what are you going to do?” said Kim Wagner, assistant manager of Pavilion Ice Cream and Yogurt, which sits next to the horseshoe on Ocean Boulevard. “We just hope they [construction crews] leave soon.”

Business owners said while they’re concerned the construction might get in the way of people heading to Main Street for the Society of Stranders Spring Safari, which begins Thursday, they hope the 10-day event will help improve business.

Construction will continue on the beach side of the horseshoe until early May, city spokesman Patrick Dowling said.

“On the Ocean Boulevard side, things have to be out of there and [the road] paved by April 25 because the Divas Half Marathon is April 27,” Dowling said.

The half marathon route starts and ends on Ocean Boulevard near Main Street. About 5,000 runners participated in the event last year.

Asked if there was a contingency plan if work was not complete on the road, Dowling said, “It will be done. There’s no alternative. We’ll just have to hold their feet to the fire. … We will have the divas and they will run on the nicely paved Ocean Boulevard.”

Dowling said the horseshoe will reopen in early May as an unpaved parking lot for the summer. More work will be done in the winter, including installing amenities and possibly a permanent public restroom, before the horseshoe is paved before the 2015 summer season. Final plans for the configuration of the new horseshoe have not yet been finalized, Dowling said.

Owners of businesses on Main Street and Ocean Boulevard said the closed intersection also has caused a lot of confusion for their customers.

“We’ve had customers call and say, ‘I see cars parked, but how do we get down there?’ ” said Rosa Brigman, an employee at Emmi Lu’s Unique Boutique on Main Street. “I tell them to just drive on down. … The [detour] sign makes people think the road is closed.”

Wagner said some tourists told her they would have stayed somewhere else had they known the construction would be going on.

Ernie Ward, an Atlanta resident who owns a home in Cherry Grove, said he wasn’t pleased with the construction as he walked around Main Street on Tuesday.

“It sucks,” he said of the inconvenience, adding that he wasn’t convinced the work would be done by April 25. “If they’re trying to have it all paved by the 25th, they need to get off their rear end.”

Construction on the outfall began in September. Two ice storms this winter put work behind schedule, but crews were allowed to work day and night on the beach side of the project, allowing them to make up time, Dowling said.

“We don’t want to be working around when the first blush of tourists come to town,” Dowling said.

The Main Street outfall will be the city’s fifth project to replace outfall pipes that were put in decades ago. The old pipes rest on top of the sand for the most part and potentially drain bacteria into the swim zone.

Myrtle Beach bans beach tents from Memorial Day to Labor Day

If you visit Myrtle Beach between Memorial Day and Labor Day and want to shade yourself, you’ll have to use an umbrella.

Myrtle Beach on Tuesday became the second Horry County entity to ban tents and all other shading devices, besides umbrellas, on the beach.

North Myrtle Beach passed a similar law last week.

Myrtle Beach City Council voted 5-1 Tuesday to ban the tents, with only Councilwoman Susan Grissom Means voting against it. She also voted against the first reading of the ordinance two weeks ago.

“I have to reiterate,” Means said. “I’m against this ordinance. I think it’s wrong to tell people that they can’t [have] a way to shade their babies and the elderly from the sun.”

Means said babies need extra protection from the sun and sand, suggesting during a morning workshop that council members amend the ordinance to include small baby pop-up beach tents.

City manager Tom Leath also encouraged council members to consider making an allowance.

“We need to focus on what exactly we want to ban during the summertime,” Leath said. “Do we really want to tell the mamas they can’t have their little baby shaded?

“If we can control the smaller shading devices that don’t impact public safety, I don’t understand why we’re taking those away. Think about what we’re telling our guests and our residents that they cannot have on the beach.”

Tents have been discussed among officials in Grand Strand beach communities for the past few years and most recently resurfaced during a June meeting of Myrtle Beach’s Beach Advisory Committee.

Law enforcement officers and lifeguards have said the tents block their view of the beach, as well as their paths when emergencies occur on the ocean.

The issue went to the Coastal Alliance, a group that represents Horry County and cities along the Grand Strand, and members said they wanted to pass uniform rules in Horry County, Myrtle Beach and North Myrtle Beach to ease any confusion among visitors.

“When we started this discussion two years ago, there was a sincere effort, I thought, among the three organizations to have as close to mirror ordinances as we could have,” Councilman Wayne Gray said. “I’m just frustrated that [is not happening].”

North Myrtle Beach City Council has changed its law, banning tents in all areas of the city from May 15 through Sept. 15. Horry County Council passed first reading of an ordinance March 11 banning tents year-round. A county ordinance requires three readings to become law.

Surfside Beach Mayor Doug Samples said last month that the upcoming election, scheduled for April 8, is slowing things down.

“We’ll take a wait-and-see how the county proceeds,” he said. “But we’re not going to reinvent the wheel. We’ll take action if the county does.”

“All of the governments are going different ways,” Leath said, adding that the laws already weren’t uniform, so it gave Myrtle Beach an opportunity to amend their ordinance to allow smaller tentlike shading devices.

Council members said even though tents only were banned during a portion of the year in North Myrtle Beach and year-round in Horry County, they wanted to at least remain consistent on the fact that only umbrellas would be allowed.
